The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to engage in business with The Company for the express purpose of the Company’s stated services and products, in accordance with and subject to, prevailing law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Cur Non Travel directly offers tourist services, particularly excursions, tours, visits, recreational, cultural and gastronomic discovery activities. Any reservations made on this website or any of its affiliated websites, imply full acceptance of these terms of sale and the payment of the sums due in respect of bookings made. These Terms and Conditions can be amended and updated at any time and without notice.

DISCLAIMER EXCLUSIONS AND LIMITATIONS

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, this Company:

-Excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature;

-Excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

PAYMENT POLICY

Your Tour Reservation

  1. Upon receipt of your deposit and subject to availability, Cur Non Travel will reserve your place on your selected tour.

  2. A deposit of 1 00€ per person is required, along with a completed booking form to secure your booking.

  3. The payment of the balance of the tour cost will be invoiced 120 days prior to the tour start date, and must be paid 90 Days prior to the tour start date.

  4. Documentation will not be forwarded until full payment has been received by Cur Non Travel.

  5. There will be no discounts offered for payment in full at the time of booking. Cur Non Travel accepts payment by major credit card, or wire transfer. All prices will be quoted in Euros and tendered in EU€.

  6. It will be the traveller’s sole responsibility to have Euros on hand for incidental expenses such as tips, gifts, souvenirs, and other items not expressly outlined in the travel itinerary. Cur Non Travel will not be responsible for the currency exchange rate.

If you do not receive an invoice or acknowledgement in the mail, via e-mail, or with your Product, information about your purchase may be obtained by contacting us at hello@curnontravel.com or by phone +33.(0)6.49.09.49.21

Terms of payment are within The Company’s sole discretion, and unless otherwise agreed to by The Company, payment must be received by The Company prior to The Company’s acceptance of an order. Payment for the products will be made by credit card, wire transfer, or some other prearranged payment method unless credit terms have been agreed to by The Company.

THE COMPANY DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE, LOST PROFITS, LOSS OF BUSINESS, OR THE PROVISION OF SERVICES AND SUPPORT. EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE COMPANY WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, THE COMPANY IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT INVOICED FOR THE APPLICABLE PRODUCT. NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, THE REMEDIES SET FORTH IN THIS AGREEMENT SHALL APPLY EVEN IF SUCH REMEDIES FAIL THEIR ESSENTIAL PURPOSE.

You agree to comply with all applicable laws and regulations of France. You agree and represent that you are buying only for your own internal use only, and not for resale or export. The Company has separate terms and conditions governing resale of Product by third parties.

The Parties agree that this agreement, any sales there under, or any claim, dispute or controversy (whether in contract, tort, or otherwise, whether preexisting, present or future, and including statutory, common law, and equitable claims) between Client and The Company arising from or relating to this agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this agreement, The Company’s advertising, or any related purchase shall be governed by the laws of France, without regard to conflicts of Laws rules.

All products, tours and services offered by The Company are valid as per the dates displayed at curnontravel.com.com or any affiliated website. The Company is not responsible or liable for any information that it does not directly provide.

Prices listed on The Company’s websites or affiliated websites are per person and include TVA unless otherwise specified. Prices are shown in Euros (EUR). The Company accepts the following credit cards Mastercard, Visa, AMEX and Discover.

What is not included in the tour price:

Airline and train fares to and from your tour starting destination, Airport Taxes, Passport and Visa fees, Insurance, phone calls, personal expense money, medical fees, meals and beverages not detailed in the Itineraries, Tips, Items of a personal nature, excess baggage, optional extra excursions, and anything not listed in the “ What’s included “ section of the Itineraries.

CANCELLATION POLICY

We understand that plans can change unexpectedly, and we strive to accommodate our clients as best we can. To ensure transparency and fairness, we have developed the following cancellation policy:

Notification of cancellation is required via email on hello@curnontravel.com. While we empathize with unforeseen circumstances, please note that 100% refunds are not possible due to the expenses incurred in preparing for your tour. These include fees to our booking system and bank, advance ticket purchases to museums, and administrative costs.

In the event of a cancellation, we will make every effort to reschedule your tour, subject to our business practices and availability. Please be aware that rescheduling may incur an additional charge to cover new ticket reservations. However, if the original reservation is missed or skipped, we reserve the right to charge the full price for new tour reservations.

We also reserve the right to deny rescheduling if the notification is received less than 10 days before the tour start time.

If you decide to cancel your booking, the following cancellation conditions apply:

Period of Notice

  • 180 days or more Prior to the the Tour Start Date, a full refund of the deposit

  • 90-179 days or more Prior to Tour Start Date, the 1000€ deposit can be applied to another future tour or it is lost

  • 89 Days or less Prior to Departure, 100% of the paid-in tour cost is lost unless a mutually agreed upon transferee is found. (so yeah, don’t cancel within 89 days of the tour start date!)

If the reason for cancellation falls within the terms of your Travel Insurance policy then any such charges may, subject to the terms of your insurance policy, be refunded to you by the insurance company.

In the event that the tour does not proceed due to insufficient reservations, any prepayments will be refunded in full.

Cur Non Travel will not offer a discount or a refund for any portion of the tour you elect not to use or be part of. This includes but is not limited to meals, entry fees, accommodation, transfers etc…

Transfers are allowed, but If you transfer your tour reservation to another party Cur Non Travel reserves the right of refusal of such transfer and a cancellation fee may apply. Any transfer will be subject to a $250 administration fee per traveler.

Change in Number of Participants – Refund Policy: If the number of participants changes after the booking has been confirmed, we unfortunately cannot offer a refund for the individuals who choose not to attend the tour. This is because we must purchase non-refundable tickets in advance, and we also incur fixed fees from payment processing and booking systems, which are likewise non-refundable. Price differences between, for example, 3 and 4 participants or 5 and 6 participants, are primarily due to these fixed costs for entrance tickets and transaction systems, rather than our guiding fees.

We appreciate your understanding and cooperation in adhering to these policies, which allow us to continue providing exceptional service and experiences to all our clients.

FORCE MAJEURE

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any Agreement contained herein.

If a tour has been started, if the tickets have been bought, the driver and/or the guide started their services, Cur Non Travel won’t be able to reimburse the cost of the service in case of an unexpected event that is not due to Cur Non Travel.

Variations

From time to time circumstances beyond the control of Cur Non Travel may require us to make changes to our itineraries.Cur Non Travel reserves the right, at our absolute discretion, to make such changes if required, but will always strive to operate the tour as close as possible to the original itinerary. Any changes will be advised in writing at all times.

Travel Documents

A valid passport with more than 6 months travel left on it is required for all International Travel, in some cases a visa may also be required. You must provide Cur Non Travel a copy of your travel documents at least 90 days prior to your departure.

You must inform Cur Non Travel of your inbound and outbound travel plans at least 60 days prior to your departure. Travellers usually arrive 2-3 days prior to the tour start date.

Travel Insurance

It is not a requirement of Cur Non Travel that all travellers must have a comprehensive travel Insurance policy, but it is advised. If you do coordinate a policy, please provide proof no later than 90 days from the date of departure.

Cur Non Travel can assist you in arranging travel insurance if required. We recommend starting at www.insuremytrip.com. It is typically required to bind an insurance policy within 15 days of placing a tour deposit.

Acknowledgements

  1. Cur Non Travel strives to provide a safe, enjoyable and memorable travel experience for all passengers. Cur Non Travel welcomes travellers with special needs or disabilities, however please note the following:

  2. Travellers are required to advise Cur Non Travel, in advance, of any physical, medical or other special needs that require accommodation.

  3. All Travellers must ensure they are medically and physically fit for travel.

  4. Cur Non Travel does not provide personal devices such as wheelchairs, hearing aids or prescription eyeglasses.

  5. Travellers should be aware that some of the tours may include extensive walking over cobblestone streets, uneven pavements, trails, and steps that may not be wheelchair friendly.

  6. Meeting times: Clients must respect the indicated pick-up locations and times in order for Cur Non Travel to adhere to pre-arranged itineraries. If a client is more than 15 minutes late for the agreed upon pick-up time, Cur Non Travel will leave without the client and that portion of the tour will not be reimbursed. So, be ready!

  7. If you have a complaint about any of our services you must tell us immediately so that the situation can be rectified quickly. Please note that we cannot be liable for any complaints or problems where you fail to bring the matter to our attention during the tour. If we can’t resolve the problem immediately, you should make a written report to us within 28 days of the end of our tour. Our contract with you is subject to France law and all disputes are subject to the exclusive jurisdiction of French courts.

  8. Compensation: If we or any of our suppliers fail to or improperly perform any obligation regarding your tour, we will pay reasonable compensation to you, subject to the limits stated below. Compensation will NOT be paid if the failure or improper performance is not due to any fault on our part or on the part of our suppliers, because it is attributable to:

    ~~your own fault; or

    ~~a third party unconnected with the provision of the services contracted and is unforeseeable or unavoidable;

    ~~unusual and unforeseeable circumstances beyond our control which could not have been avoided even if all due care had been exercised; or

    ~~an event which we or our suppliers could not foresee or forestall, even with all due care.

  9. Unreasonable conduct: In the extremely unlikely event of unreasonable conduct by you that is likely to cause damage, danger or serious disturbance to other clients, employees, property or any third party, we reserve the right to terminate the provision of services contracted to you. In the event of our terminating the contract for these reasons, full cancellation charges will apply and we will be under no obligation to refund or compensate you for any loss you may incur. So, behave!

  10. By completing the Cur Non Travel Booking form and clicking the check box on the checkout page, you acknowledge and accept Cur Non Travel Terms and Conditions.

  11. You acknowledge and agree that there are general risks associated with traveling, which are beyond Cur Non Travel’s control and Cur Non Travel cannot be legally responsible for any loss or damage you may incur as a result of these general risks.

  12. From time to time photos from the various tours will be used on the Cur Non Travel website, social media pages or other advertising media. All travelers are required to complete a release form allowing us /not allowing us to use these photos. Failure to complete this form will be seen as permission to use photographs as we wish toward the promotion of Cur Non Travel wine and food tours in the future.

WAIVER

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

GENERAL

The laws of France govern these terms and conditions. By accessing this website and using our services you consent to these terms and conditions and to the exclusive jurisdiction of the French courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision.
